The WGNtv.com Boo-tiful Babies Photo Contest ("Contest") starts at 5:00am (CT) on Tuesday, October 18, 2011, and ends at 2pm (CT) on Tuesday, November 1, 2011, ("Contest Period"). The Sponsors of this Contest are George Street Photo and Video, 4314 North Lincoln Ave, Chicago, IL 60618 and WGN-TV, 2501 West Bradley Place, Chicago, IL 60618. The Contest shall be conducted on the website of WGNtv.com ("Participating Website"). The Contest shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein.
HOW TO ENTER:
No purchase necessary to enter or win. A purchase will not increase your chances of winning. To enter, visit wgntv.com/contests. Accurately complete the online entry form by submitting your name, age, address, telephone number, e-mail address and uploading ONE (1) photo of the baby, ages newborn to 24 months (.jpg or gif file) (the "Photo"). The Photo must depict only the entrant. Altered or electronically enhanced Photos will not be considered. Sponsors will not be responsible for failed Internet connections, unavailability of servers or any other technical malfunctions for any reason. Photos will be accepted starting Tuesday October 18, 2011. All photo entries must be received by 2 pm (CT) on Tuesday, November 1, 2011. Voting will begin Wednesday, November 2, 2011 at 2PM (CT) and conclude on Friday, November 11, 2011 at 2PM (CT). Sponsors' clock shall be the official clock of the Contest. Limit one entry per person and per e-mail address. Only complete entries sent to the designated web site shall be eligible. Entries become the property of Sponsors and will not be returned. Any expenses you incur during the application process are your sole responsibility. Sponsors will not reimburse you for these expenses. If any dispute arises as to identity of entrant, entrant shall be considered person who owns Internet account through which entry was sent to Contest.
Any attempt by any entrant to obtain more than the stated number of entries using multiple/different identities or registrations will void such entries and that entrant may be disqualified. No electronic or mechanically reproduced entries and the use of automated or third-party software of website to enter are prohibited. Only entries complying with the entry rules shall be counted in the Contest. Sponsors are not responsible for inability to submit entries within specified time, whether due to disconnections, technical malfunctions or other circumstances. Sponsors are not responsible for entries which are lost, late, misdirected, or illegible. Odds of winning prize depend on the number of eligible entries received for that week's drawing.
ELIGIBILITY RESTRICTIONS:
a.The Contest is open only to legal citizens of the United States. Entrants must be legal residents of Cook, DeKalb, DuPage, Grundy, Kane, Kankakee, Kendall, LaSalle, Lake, McHenry and Will counties in Illinois, and Jasper, LaPorte, Lake, Newton and Porter Counties in Indiana.
b. Employees (and their immediate family or household members) of WGN-TV and ("Sponsors") and their respective subsidiaries, sponsors, affiliates, parent companies, assignees, agencies, advertisers, franchisees, promotion and delivery contractors, prize providers, and/or public relations companies are not eligible to participate. Employees of participating clients and their advertising agencies, or of other media companies including all radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriages(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the household whether or not related.
c. A potential winner may be requested to provide the Sponsors with proof that the potential winner is the authorized account holder of the e-mail address with the winning entry and that all eligibility requirements are met.
d. Any member of a household that has been awarded a prize in any other contests by WGN-TV within the last 6 months is ineligible. e. You must be the parent or legal guardian of the child depicted in the photo. The child must be between the ages of newborn and twenty-four (24) months at the time the photo was taken. Photo must be taken between 10/1/11 and 10/31/11. You are free to depict twins, triplets, etc in the Photo, but no other people should appear in the Photo.
CONDITIONS OF ENTRY:
a.Execution of Affidavit and Release: The prizewinners are required to sign and submit a release and waiver of liability. To claim the prize, the prizewinner will be required to provide picture proof of identification, which may include a driver's license, passport, voting card or similar government issued identification.
b.Use of winner's name: By entering, each entrant grants permission, without further compensation, to Sponsors and their agents and licensees, to use the entrant's name, voice, photograph, likeness and biographical material for broadcast and promotional purposes in connection with the Contest in the event entrant is a winner.
c.Release Sponsors of Liability: By entering, entrants agree to release Sponsors and their parent companies, affiliates, officers, directors, employees, licensees, representatives & agents from any claim, loss, liability, damage or injury of any kind arising from the entrants' participation in this Contest. WINNER SELECTION AND NOTIFICATION: All qualifying entries will be accumulated into one database for judging. Visitors to wgntv.com will be allowed to vote for their favorite candidate in the Voting Phase as described below. At the end of The Voting Phase, the candidates whose entry receives the highest number of votes will be the Winner, subject to eligibility confirmation and compliance subject to all rules and regulations.
Final Round - Voting Phase: Wednesday, November 2, 2011 at 2PM (CT) and conclude on Friday, November 11, 2011 at 2PM (CT). All entrant photos will be posted for the Final Round no later than 2pm on November 2, 2011. On-line voting will be conducted from 11/2/11 through 2pm on 11/11/11. On November 2, 2011, the photo that receives the highest number of votes during the first round will be deemed the winner. The winner is subject to eligibility confirmation, relationship confirmation, and compliance with these rules. The winner will be notified by phone on or about November 11, 2011.
If the winner is determined to be ineligible, cannot be reached by reasonable means within a reasonable amount of time or who otherwise fails to comply with these Official Rules he/she shall be disqualified, and the first runner up (i.e., the Finalist with the next highest number of votes earned during the Voting Round) shall be deemed the winner. There is no limit on the number of votes that may be cast by an individual; however, vote submissions containing technical or electronic reproductions, voting by e-mail and votes containing attached files are not eligible and will be rejected.
Winner must claim prize at WGN-TV, 2501 West Bradley Place, Chicago IL 60618. Prize winner will have 30 days from date of notification to claim his or her prize.
PRIZES:
One "Grand Prize" will be awarded: a 90 minute family portrait session at a Chicago location of the winner's choosing provided by a Certified Lead George Street Photo & Video Photographer. All photos will be available online, and the winner will also receive a free 11x14 archive quality print of their favorite family pose (ARV $350) The winning image may also be featured online on the Sponsors' websites with no payment to child, his or her parent(s) and/or legal guardian(s). Total approximate retail value ("ARV") of prize is $350. Prizes are not transferable or redeemable for cash, and prize substitution will not be allowed, except at the discretion of the Sponsors. Winner may claim their prize at WGN-TV at 2501 West Bradley Place, Chicago, IL 60618. Sponsors reserve the right to substitute a prize of equal or greater value if the prize is unavailable and/or undeliverable for any reason in the sole and complete discretion of Sponsor. Winner is responsible for all taxes on prizes. All properly claimed prizes will be awarded, but in no event will Sponsors award more prizes than are provided for in these Official Rules.
OTHER CONDITIONS OF ENTRY:
Entrants represent and warrant that no laws were broken in the creation of the Photos and that their Photos are their own original creations, have not been copied in whole from any other work, have not been previously published, do not violate the rights of any other person or entity (including but not limited to privacy rights and copyrights), do not defame, libel, or slander anyone or any entity, and do not contain offensive, vulgar, obscene or profane content, as determined by Sponsors. Babies may not be depicted in any way that could be harmful to the child, and the Photo must not contain any depiction of genitalia. Photos that do not comply with these Official Rules or that breach the foregoing representations and warranties shall be disqualified. Entrants agree to indemnify, defend and hold Sponsors harmless against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys' fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to a breach of the foregoing representations and warranties. Eligible Photos will be displayed on the Contest website. All entries become the property of the Sponsors and will not be returned or acknowledged. Winners grant to Sponsors a world-wide, perpetual license to use their winning Photos in any manner related to the Contest, without prior notice, approval or compensation, including but not limited to the first right to publish the winning images in any medium. Winners otherwise will retain all rights to their Photos, and the Sponsors' publication of the Photos will not limit their use and ability to further market the Photos.
PUBLICITY:
By entering this Contest, contestants agree on behalf of themselves and the baby or babies portrayed in the Photo to allow use of their and their baby's name, voice, photograph, likeness, any information provided on entry form, and their Contest Photo submission in any medium of communication, including but not limited to print, Internet, radio and/or television and for any purpose, including advertising, promotional or other purposes, by Sponsors and their licensees and affiliates, without additional compensation.
OFFICIAL CONTEST RULES AND NAME OF WINNER:
Official Rules are available at wgntv.com/contests, or by mailing a self-addressed, stamped envelope to, Boo-tiful Babies Photo Contest, WGN-TV , 2501 West Bradley Place, Chicago, IL 60618 by December 11, 2011. For the name of the winner, send a self-addressed, stamped envelope, after November 11, 2011, but before December 11, 2011 to Boo-tiful Babies Photo Contest Winner, at the same address. SPONSORS: Contest is sponsored WGN-TV, George Street Photography.
INTERNET:
Sponsors are not responsible for printing or typographical errors in any Contest-related materials; for entries that are late, misdirected, deleted, incomplete, inaccurate, or garbled or entries that are processed, reported, or transmitted late or incorrectly or are lost for any reason, including computer, telephone, paper transfer, human or other error, or for electronic, computer or telephonic malfunction or error, including inability to access any website associated with this Contest, or process any transaction thereon. If for any reason this Contest is not capable of running as planned, or if this Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsors' opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsors reserve the right, at their sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Contest or any portion thereof. In the event this Contest is cancelled, the judges panel will select winners applying the criteria set forth above to all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification, or suspension occurs, notification will be posted at the Entry Site. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE (INCLUDING THE ENTRY SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST WILL RESULT IN DISQUALIFICATION.
